With its decision in Obergefell v. Hodges, 576 U.S. ___ (2015), the United States Supreme Court concluded that "the right to marry is a fundamental right inherent in the liberty of the person, and under the Due Process and Equal Protection Clauses of the Fourteenth Amendment couples of the same-sex may not be deprived of that right and that liberty."
"The Court now holds that same-sex couples may exercise the fundamental right to marry," the Court said. "No longer may this liberty be denied to them."
In 2010, approximately 25.7 percent of all same-sex couple households reported that they were spouses. That equates to approximately 152,000 housesholds. With the right to marry, so comes the right to divorce. Just as lesbian, gay, bisexual, transgender, and queer (LGBTQ) couples now enjoy equal rights, they share many of the same concerns as heterosexual couples during divorce proceedings. Certain kinds of situations, however, can become even more complicated for same-sex couples.
