Simple Divorce

Simplified dissolution of marriage, also referred to as a simple divorce, is a possible option or type of divorce available when the following conditions exist:

  • The spouses do not have any minor children (by birth or adoption) of the marriage;
  • The wife is not pregnant at the time of filing;
  • The spouses agree in writing how the property and debt will be divided;
  • The spouses must waive the right to alimony; and
  • The spouses must waive the right to appeal.

If any of the aforementioned conditions are not met, then a simple divorce is not an option.

Do I Need an Attorney for a Simple Divorce?

First, when spouses say they want a simple divorce, they often mean they both agree on most aspects of the divorce. For example, the spouses may agree on who keeps the family home or a vehicle.
